Resolving in favour of non offenders.

In a claim, any doubtful point as to a claim shall be resolved against the claimer.

In my head, this "favouring the non-offenders" applies more generally, but if it does I can't find it anywhere.

Have I made it up, or have I missed it?

I'm particularly thinking of cases where we have to decide what a non-offender would have done, for example after misinformation.

  • Certainly some of the other laws have similar references, and it's certainly a general principle of how we apply the law. I'm not sure if it's specified anywhere. Law 12 on adjusted scores has multiple references to protecting the non offending side, that'll cover many situations.

Got it. Hidden away in 84 D , Rulings on agreed facts. "The director rules any doubtful point in favour of the non-offending side"
